Tabitha Karanja the CEO Keroche Breweries have expressed claims that the DPP seemingly do not want to prosecute those responsible for the death of her daughter.
Tecra Muigai who was the director at Keroche Breweries, owned by her parents, passed on in May. It was alleged that the deceased fell from a balcony. But the police insisted that her death was not an accident.
As a result, Tecra’s boyfriend, Omar Lali was charged with murder. See article. Lali was later discharged and the murder charges dropped. See article.
However, Tabitha Karanja has raised suspicions in the way the DPP is handling the case.
The CEO has filed an affidavit in court challenging the inquest to transfer the case from Milimani courts to Lamu, claiming that it poses threat to their lives.
A number of things that have happened as I will detail below. And the request by the DPP to this court referred to above have triggered extreme and well-founded suspicion in me and the entire family of the deceased. That the conduct of the Director of Public Prosecutions is inconsistent with the constitutional and statutory principles that ought to guide the conduct of the DPP in handling this matter.

So Tabitha complained that the accused, Omar Lali is a very influential person among boat owners and operators. And seeing that boat transport is the only reliable source of transport to access Lamu island, there is profound fear in the family members.
As a result, the family is scared that they may not be able to travel to Lamu. So as to attend to or participate in the inquest proceedings without a substantial threat to their lives and security.
Tabitha Karanja went ahead to explain that it came as a shock to them to learn that the DPP had made a random decision to withdraw the proceedings from Milimani.
The court has since directed the DPP to file a response to the affidavit by Monday, October 14, 2020.
